In the past, levies against bank accounts were primarily placed against accounts held at traditional banks known as a "bank levy." Money for basic needs. If unable to reach a voluntary payment arrangement, a creditor may place a lien on property held by the debtor, garnish wages and attach a levy to any monies held by financial institutions.
If the bank does not respond, the creditor is responsible for contacting the bank. This form states how much money is in the account and if the bank was able to locate a safe deposit box. Banks must provide a completed memorandum of garnishee to the Sheriff’s Office within 15 days of receiving the levy. If such a duty exist, eveyone would clean out their account before the funds were taken. That would defeat the purpose of a bank levy. You got stuck in what I call "the pickle." Your bank does not have a duty to notify you prior to the levy of your account.
